Global Licensing Agreement

This End User License Agreement (hereinafter referred to as the "Agreement") constitutes a binding legal contract between you (the "Licensee") and Infinite Galleria (the "Licensor"). By purchasing, downloading, or using any digital assets (the "Content") from this platform, you acknowledge that you have read, understood, and agreed to be bound by the terms set forth herein.

1. Definitions

For the purposes of this Agreement:

"Content" refers to any digital image, artwork, or media file available for purchase on Infinite Galleria.
"Commercial Use" means the use of Content for any purpose that is intended to generate revenue, including advertising, marketing, packaging, and client deliverables.
"Personal Use" means non-commercial use for display on personal computers, private collections, or educational purposes.

2. Grant of License Rights

The Licensor grants the Licensee a non-exclusive (unless stated otherwise), non-transferable, worldwide right to use the Content subject to the specific License Tier purchased as detailed below:

B. COMMERCIAL ($199)	• Business & Professional Use. • Permitted: Advertising campaigns, architectural presentations, client deliverables, physical printing. • Ownership: Copyright remains with Infinite Galleria.	• Format: Multi-Pack (TIFF, PNG, JPG) • Resolution: 8K (Ultra-High)
C. EXCLUSIVE ($499)	• Full Buyout & Transfer. • Permitted: Unlimited reproduction, resale, and trademarking. • Ownership: Full Copyright Transfer to Licensee.	• Includes all Commercial Files (8K Master Bundle) • Store Action: Product is permanently removed.

3. Exclusive Ownership & Retroactive Rights

3.1 Market Freeze

Upon purchase of the Exclusive Ownership tier, Infinite Galleria agrees to immediately cease all sales and distribution of the specific Content. The Content will be removed from the public storefront.

3.2 Validity of Prior Licenses

IMPORTANT: The purchase of Exclusive Ownership does not invalidate or terminate any Standard or Commercial licenses granted to other Licensees prior to the date of the Exclusive purchase. These prior licenses shall remain valid and active in perpetuity (Non-Retroactive Clause). You are purchasing the future exclusivity of the work.

4. Restrictions

Except as expressly permitted by the purchased License Tier, the following restrictions apply to all Content:

No AI Training: The Licensee shall not use the Content for the training of artificial intelligence (AI) systems, machine learning models, or generative algorithms.
No Unlawful Use: The Content may not be used in connection with any pornographic, defamatory, or otherwise unlawful material.
No Standalone Resale: Unless the Exclusive Ownership tier is purchased, the Licensee may not resell, redistribute, or sublicense the Content file itself as a standalone stock asset.

5. Intellectual Property & Warranties

5.1 Ownership: Infinite Galleria retains all rights, title, and interest in and to the Content (including copyright), except where the Exclusive Ownership tier is explicitly purchased.

5.2 Warranty: The Licensor warrants that the Content is original and does not infringe upon the copyright, trademark, or other intellectual property rights of any third party.

5.3 Indemnification: The Licensee agrees to indemnify and hold harmless Infinite Galleria against any claims, damages, or expenses arising from the Licensee's use of the Content in violation of this Agreement.

6. Termination

This Agreement is effective until terminated. Infinite Galleria reserves the right to terminate this Agreement immediately if the Licensee fails to comply with any provision herein. Upon termination, the Licensee must cease all use of the Content and destroy all copies.

7. Governing Law

This Agreement shall be governed by and construed in accordance with international digital commerce laws and the laws of the jurisdiction in which Infinite Galleria is registered. Any disputes arising from this Agreement shall be resolved through binding arbitration.
